The Supreme Court bench that was initially supposed to pass a judgment on the Special Leave Petition filed by the Andhra Pradesh Government, in which it requested for the postponing of the local elections, was the bench headed by Lavu Nageswara Rao. The case has now gone to the bench headed by Justice Sanjay Kishan and Justice Hrishikesh Roy.
The Andhra Pradesh government had filed a Special Leave Petition in the Supreme Court, challenging the High Court’s judgement, which said that the elections should be conducted as per the SEC’s schedule, and that there should be no interference from the government in this matter, as the SEC has all the powers that the CEC has, and that the SEC is an independent Constitutional body whose independence is to be respected.
Awaiting this judgment from the Supreme Court, despite the SEC releasing the election notification, the AP government clearly specified that it would not cooperate with the SEC, until the SC passes its judgment.
After the AP government filed its petition in the Supreme Court, the SEC too filed a Caveat petition in the Supreme Court, urging the SC to listen to its side of the argument as well. Both of these petitions will come up for hearing tomorrow at the SC, in front of the same bench.
