AP High Court: SEC will not bear the Kangaraju’s Expenses

The AP High Court has been too busy for the past few months as they have been put right under pressure by the AP Government since they issued a negative verdict to the YS Jagan’s government in the Nimmagadda Ramesh Kumar’s case. Of course, the controversial decisions taken by the government and the reported personal attacks from the ruling party people never really hit the morale of the judicial bench.

Now, the High Court has passed a verdict on a petition filed by the State Election Commission. The AP High Court made it clear that the SEC will not have to bear the legal costs incurred when former Tamil Nadu Justice Kangaraju was appointed as the SEC by the Andhra Pradesh government.

The judicial bench confirmed that if Kangaraju had appointed legal counsel, all those charges should be borne by Kangaraju himself and all those legal expenses and costs should not be borne by the State Election Commission. The court also asked the SEC to reconsider bearing Rs 20 lakh for the accommodation and Rs 15 lakh furniture expenses incurred when Kangaraju was the election commissioner.

It is known that the retired Madras High Cost Judge Kangaraj was made the AP’s state Chief Election Commissioner in the place of Nimmagadda Ramesh Kumar who was expelled from his duties through an overnight ordinance while the latter fought all his way through to regain his post in a most sensational manner. Now, the AP people are very much concerned with the cases that are being heard in the High Court.

The above case can logically be given verdict by a primary class student without any knowledge of the sections, laws and amendments in the constitutions. It is a pity that the state’s highest judicial council has to hear these kinds of cases regularly these days and thanks to the Jagan Mohan Reddy Government for making everyone’s lives so complicated with their controversial decisions.

On the other side, The High Court on Tuesday observed that the Andhra Pradesh government was willfully not cooperating with the State Election Commissioner. Once again the High Court clarified that “the Governments will change but the Constitution remains the same. Democracy will always be in huge danger if the constitutional rights are in danger.”
