Supreme Court finds fault in HC’s summoning Govt Officials

The Supreme Court of India has issued guidelines that it is not appropriate to summon government officials to the high courts unnecessarily.

A special bench comprising Justice Sanjay Kishan Kaul and Justice Hemant Gupta said it is not appropriate to summon the officers and put indirect pressure on them. The bench clarified that the judiciary and the executive have specific powers in different ways and that the courts have acted to narrow down the system of government.

The Constitution says the three -legislative, judicial and executive systems are equal and it is not proper for any of these three to intrude upon the domain of another, otherwise it will upset the delicate balance in the Constitution, and there will be a reaction.

The bench clarified that unnecessarily summoning an officer to court is a violation of employee duties, which ultimately places the burden on the public.
