NDPS court that granted bail to actor Rhea Chakraborty’s brother Showik, dismissed drug trading charge on him. It claimed that rigorous charge of financing illicit drug scandal did not apply in his case.
The charge under Section 27A of the Narcotic Drugs and Psychotropic substances act attracts at least 20 years of imprisonment.
This became crucial for the court and imposed 3 months of jail while rescinding Showik’s bail petition. Showik was captured by the Narcotics central Bureau (NCB) on September 4 in the drug trafficking case post Sushanth’s mysterious death.
In a detailed court notice, special judge G B Gurao stated: “The court h has to see that there are reasonable grounds for believing the accused is not guilty. The ingredient of Section 27A of NDPS
are absent in the case of applicant”.
The court observed that Showik was nabbed based solely on statements to NCB and asserted, it cannot be considered as a confessional statement to convict the accused. The court also emphasised as per the stated prosecution, no drugs were recovered from Showik and has nothing to do with it’s seizure of contra band drugs and LSD from co-accused Anuj Keshwani.
